Privacy Policy

Agreement. This is the Privacy Policy governing the collection and use of information gathered from or about you through Kuotz.com (the “Site”) and is intended to identify for you the nature of information that may be collected and the way such information may be used and disclosed.  This Site is operated by Kuotz, LLC (“Kuotz,” “us” or “we”).  Use of the Site constitutes your acceptance of and agreement to this Privacy Policy and the Site’s “terms of use”:/terms (the “Terms of Use”), and the Site’s “Bidding Process”:/bidding, which are hereby incorporated by reference.  Please review this Privacy Policy, the Bidding Process and the Terms of Use before you use our Site to be sure you are comfortable with their terms.

Types of Information We Collect.  The nature of the information we collect, use and disclose depends on your use of the Site and the features and services you select to use. If you merely visit our Site and do not use any of the services, register, or specifically provide or post any information, the only information we would collect would be that through Cookies (defined below). If you are a customer using the Site to obtain price quotes for specific goods or services or for bids on a particular project for you, (each a “Customer”), or if you are a service provider or supplier of goods (a “Vendor”) who is using the Site to post information about its goods or services, sell services or goods, and/or participate in the bidding process, we may collect, use and disclose information you provide or we gather from and about you by which you may be identified, such as your name, company name, address, email address, telephone number, and other information by which you may be identified (“Personally Identifiable Information”). If you sign up for a subscription, a Site service, to bid, or for other Site functions or services that require that you pay some consideration, establish a Paypal or similar account on the Site, Personally Identifiable Information collected will include financial information such as your credit card number and billing information. If you as a user elect to participate in the bidding process, you will be expected to provide additional information about the specific goods or services for which you are seeking bids. If you as a Vendor elect to participate in the “ID Verified” Process, we may collect additional information about you, such as Social Security numbers, Employer Identification Numbers, as well as your name, company name, address, state of incorporation or formation, and similar limited information, and we submit it to our verification service providers for verification.

When Information is Collected. This information may be collected from you as you use the Site, including where you specifically provide it, if you post it so that it is visible to other users, when you register at our Site, if you request information, products or services, if you participate in the Bidding Process, and/or if you communicate with us via email through the Site. “Cookies” is a term used for technology that stores useful information about visitors or their computer information when they visit a site.  We may use cookies to capture and compile statistical information about the way in which the Site is used by our users, but this information is not stored or captured in a way by which you may be identified.  You may be able to set your browser to disable some or all cookies or to notify you when a cookie is set.   However, many of the functions of the Site require cookies to be enabled to fully use such functions.

Use of Information Collected.  We will use and disclose your Personally Identifiable Information only as follows: to operate the Site, to perform the functions and provide the services you request, to improve the Site, to facilitate and improve your experience on the Site, to contact you about the Site and new features, goods and services available, and to provide the information to our service providers as needed in order for them to assist us with the operations of the Site, and as otherwise stated in this Privacy Policy. For example:

(a) To Comply with Your Requests.  We may use and disclose to others your Personally Identifiable Information to the extent reasonably necessary to provide you with the information, opportunities, and goods or services you request.  For example, if you are a customer and you have submitted a request for bids, or are participating in the Bidding Process, information you submit about yourself and the subject of the bid will be disclosed, including to Vendors.  The Site is technically structured to limit the disclosure of some information by which a Customer may be identified from the initial phases of the bidding process but as the bidding process progresses, more of the Customer’s Personally Identifiable Information is revealed to the Vendors. Please review the Bidding Process for more detailed information. We may use and disclose Vendors’ Personally Identifiable Information and other business-related information to and in communications with Site Users who are participating in the Bidding Process.  We may use your Personally Identifiable Information to contact you about your requests and activities on the Site, for example, if you are a Customer and have submitted a request for bids. In addition, if a Vendor seeks to be ID Verified, we will disclose Personally Identifiable Information to our identification checking service providers to use in checking the accuracy of your information.

(b) To Operate and Improve Our Site.  We may use your information, including your Personally Identifiable Information, to help improve the operation of our Site, such as to diagnose problems with our server, to administer our Site, and to communicate with you with respect to your use of the Site, including, without limitation, to respond to e-mails from you and to communicate with you about safety and security issues.

(c) Site News. Unless you notify us that you do not want to receive such notices, we may use your Personally Identifiable Information to notify you about new features, goods and services available on or through the Site. If you do not want to receive these notices, please opt-out at the bottom of the message.

(d) To Kuotz Successors. We may also share your information, including your Personally Identifiable Information, with and transfer it and our rights in it to any successor corporation/entity to Kuotz, which entity would have the right to use and disclose your information as we did.

(e) Aggregation of Information.  We may aggregate your information with the information of others so that you cannot reasonably be identified and we may use and disclose such de-identified (statistical) information for any purpose.

(f) Compliance with Law and Safety.  We may use and disclose information that we have gathered from you or that you have provided to us: (i)  if we believe that any law or regulation requires us to do so, (ii) to respond to a subpoena or governmental request; (iii)  as we deem it advisable or necessary to protect our safety, rights or property, or that of our employees, agents, affiliates, customers, other users of this Site, or others; (iv) to respond to a possible violation of this Privacy Policy, our Ambassador Agreement or our Terms of Use, any law or regulation; and/or (v) to enforce this Privacy Policy, our Ambassador Agreement and/or our Terms of Use.

Information That Is Not Covered. This Privacy Policy does not govern information you post so that it is visible to other users on the Site, whether in Vendor Pages, in comment and discussion sections of the Site, or otherwise. This Privacy Policy also does not govern or control use by those to whom you reveal or provide information through the Site processes (such as Vendors from whom you as a customer solicit bids or with whom you contract for goods or services or potential customers to whom you as a Vendor reveal your information). In addition, in some cases there may appear on the Site links to third party web sites on which goods or services may be offered, or advertising which, when you click on it, takes you to another site. Those sites are also not governed or controlled by this Privacy Policy. Thus, you should check the privacy policies of such sites before you decide to reveal your information to them, to be sure you understand and are comfortable with them.

No sales for direct marketing. We will not rent or sell your Personally Identifiable Information to others for their use in direct marketing to you.

Updates and Corrections, Access.  In all cases if you have corrections or updates to the Personally Identifiable Information (such as your address or your email address), or to the information about your business (such as your products or services) that we are maintaining about you, please keep your information accurate by updating your information on the Site. Access to your Personally Identifiable Information is readily available and password protected for you on the Site. General Audience Site. The Site is intended to be used by individuals who can form binding agreements and who are at least 18 years of age or older. It is not intended to be used by anyone under 18 years of age.

Users in the United States.  This Site is directed at and intended to be used only by, users within the continental United States, Alaska and Hawaii.  Users from other locations who use this Site are consenting to the use and disclosure of their information in accordance with this Privacy Policy.

Securing Your Information.  We will use reasonable precautions to keep the information about you that we have gathered protected from unauthorized use or access.  However, we are not responsible for any breach of security or for any actions of any third parties that may receive the information.

Use Caution When Visiting Other Sites. Our Site may from time to time include links to other sites, such as links to search for additional information, and links on ads. Those sites may have different privacy policies. When traveling to other sites, please take the time to check the applicable privacy policy of that site before you submit any personal information. Such policies are usually posted on the site or available through clearly posted links.

Other Sources of Information About You.  Please note that this Privacy Policy applies only to information provided by or gathered from you through this Site.  It does not apply to information we receive through other means or methods.

Monitor Your Use. We reserve the right, but are not obligated, to monitor your use of the Site.

Updates to Our Privacy Policy. We reserve the right to change this Privacy Policy at any time in our discretion.  Changes will apply to information about you that we have already gathered from you under this Privacy Policy and to information we thereafter gather from you.   With respect to changes in our Privacy Policy which affect the use or disclosure of Personally Identifiable Information we have already gathered from you prior to the effective date of the change, we will not materially change our Privacy Policy to make it less protective of your Personally Identifiable Information collected in the past, without sending you a notice to your last known email address (or, if we do not have your email address, to your last known mailing address if you have given it to us) notifying you of the changes and providing you with the opportunity to opt out of such changes within thirty (30) days from issuance of the notice.  Also, we will post at the end of this policy a summary of any material changes, including any changes that give us broader rights to use or disclose your information for marketing purposes that we make in the Privacy Policy and the effective date of such change.  Your continued use of the Site after the effective date of any change, constitutes your consent to the change.
